If you receive a Notice of Claim Status, in most cases you have 90 days to request a hearing before the Industrial Commission. The Rules of Procedure are unique to the Industrial Commission. Some documents must be submitted 25 days before the hearing and others 15 days. It takes an attorney experienced at the Industrial Commission to know the difference.

Even though it's called a "hearing" it is really your day in court. This is where you present evidence, cross-examine witnesses, and testify on your own behalf. It is very similar to what most people call a trial. If you attend a hearing without an attorney, you are bound by the special procedures. Almost always and without exception, the other side will have a lawyer.

Insurance claims adjusters and the independent medical examiners they send you to are not on your side. The claim adjuster's job is to save the insurance company as much money as possible, which may mean withholding the workman's compensation benefits that you are due.

You need a lawyer at every stage of the process. Just because the insurance company has been fair up until now, do not assume that you cannot get an attorney after your case has progressed. If you miss a deadline, you could be forever barred from receiving workers' compensation benefits. If your claim is properly filed and properly closed, you could get benefits for the rest of your life.

To receive entitlements, you must complete numerous forms to report your earnings, residence and other important information. If these forms are not properly completed, the insurance company can legally terminate your benefits.

We are committed to standing up for you and protecting your legal interests against the insurance company. If your workers' compensation benefits have been stopped, delayed or denied prematurely, contact us for assistance.
