Reopen Old Injury Case Phoenix Workers' Comp Law Firm

When an Old Injury Acts Up - Reopening an Old Injury Case

If you have had a workers' compensation claim or an industrial claim in the past, and you start to have new problems, there is good news. In Arizona, there is no statute of limitations to reopen old injury claims.

If you have a new, additional or previously undiscovered condition related to your original injury, contact the Crossman Law Offices, P.C., to have one of our experienced workers' comp lawyers review your old case and see if reopening is needed.

Our Phoenix, Arizona, workers' compensation benefits attorneys provide in-depth FREE PHONE CONSULTATIONS to answer your questions: 888-841-1197 or Contact us online.

Your Right to Reopen an Injury Claim

To reopen your old injury case you must get your previous worker's compensation file and file papers with the Industrial Commission requesting that they reopen your case. Even if your Arizona workman's compensation case has been closed for years, you have the lifetime right to reopen it.

You will need a doctor who believes that your current condition and the need for active medical treatment is related in part to the original injury to succeed in reopening an injury claim. In such a case, if the case is reopened, then you will start getting work comp benefits as you did before. You will be entitled to part of your lost wages and your medical bills related to the treatment of the industrial injury.

File to Obtain Benefits and Lost Wages

The right to reopen is based upon the belief that the result of an injury may not fully be known until years after the industrial injury occurs, or has worsened over time. The time to file a Petition to Reopen is important because you will not be entitled to medical benefits or lost wages until it is filed.
