A scheduled injury is a permanent injury to a hand, arm, or other part of the body designated in the law. An unscheduled injury is determined by where the location of your injury is and whether you have had past injuries in that part of your body. If it sounds confusing; that is because it is confusing. Dealing With Loss of Earning Capacity Questions and Permanent Disability Notices

If you receive a Notice of Permanent Disability from your company's insurance carrier, you may be entitled to a lifetime of checks to pay you for lost wages. The insurance company will make a recommendation to the Industrial Commission as to what it thinks is your permanent reduction in your monthly earnings capacity. The Industrial Commission will ask you to fill out a Loss of Earning Capacity Questionnaire.

Using information they receive, the Industrial Commission will determine if you have a permanent loss of earning capacity by issuing a Findings and Award for Unscheduled Permanent Partial Disability. You do not have to agree with their findings.
