If you receive a Notice of Claim Status, in most cases you have 90 days to request a hearing. The Rules of Procedure are unique to the Industrial Commission. Some documents must be submitted 25 days before the hearing and others 15 days. It takes an attorney experienced at the Industrial Commission to know the difference. If you miss a deadline, you could be forever barred from receiving workers' compensation benefits. If your claim is properly filed and properly closed, you could get benefits for the rest of your life. If you attend a hearing without an attorney, you are bound by the special procedures. Almost always and without exception, the other side will have a lawyer.

Even though it's called a "hearing" it is your day in court. It is where you present evidence, cross-examine witnesses and testify on your own behalf. It is very similar to what most people call a trial.
